In principle, the same legal requirements apply as for domestic employees - but there are a few points that you should pay particular attention to:<\/p>\n<h3 data-start=\"437\" data-end=\"474\">1. <strong data-start=\"444\" data-end=\"474\">General contents of the contract<\/strong><\/h3>\n<p data-start=\"475\" data-end=\"598\">An employment contract for foreign skilled workers must contain all essential content in accordance with Section 2 of the Evidence Act, including<\/p>\n<ul data-start=\"600\" data-end=\"950\">\n<li data-start=\"600\" data-end=\"646\">Name and address of both contracting parties<\/li>\n<li data-start=\"647\" data-end=\"702\">Start and, if applicable, time limit of the employment relationship<\/li>\n<li data-start=\"703\" data-end=\"720\">Place(s) of work<\/li>\n<li data-start=\"721\" data-end=\"747\">Job description<\/li>\n<li data-start=\"748\" data-end=\"782\">Working hours and break regulations<\/li>\n<li data-start=\"783\" data-end=\"827\">Remuneration including supplements, bonuses etc.<\/li>\n<li data-start=\"828\" data-end=\"843\">Vacation days<\/li>\n<li data-start=\"844\" data-end=\"865\">Notice periods<\/li>\n<li data-start=\"866\" data-end=\"950\">References to applicable collective agreements or works agreements (if applicable)<\/li>\n<\/ul>\n<h3 data-start=\"952\" data-end=\"992\">2. <strong data-start=\"959\" data-end=\"992\">Reference to residence status<\/strong><\/h3>\n<p data-start=\"993\" data-end=\"1155\">The contract should contain a clause stating that employment is only possible with a valid residence and work permit. Example:<br \/>\n\"The commencement of work is subject to the issue or continued existence of a valid residence and work permit.\"<\/p>\n<h3 data-start=\"1302\" data-end=\"1327\">3. <strong data-start=\"1309\" data-end=\"1327\">Language regulation<\/strong><\/h3>\n<p data-start=\"1328\" data-end=\"1561\">Even if the employment contract is written in German, a translation into the specialist's native language may be useful. Important: Only the German version should be legally binding - this must be clearly stipulated in the contract.<\/p>\n<h3 data-start=\"1563\" data-end=\"1606\">4. <strong data-start=\"1570\" data-end=\"1606\">Support with visits to the authorities<\/strong><\/h3>\n<p data-start=\"1607\" data-end=\"1788\">A reference to support with visa or authority issues is not a must, but a plus point in the recruiting process. If you offer help, you can record this in a contract.<\/p>\n<h3 data-start=\"1790\" data-end=\"1827\">5. <strong data-start=\"1797\" data-end=\"1827\">Additional agreements<\/strong><\/h3>\n<p data-start=\"1828\" data-end=\"1919\">Depending on the sector or country of origin of the skilled worker, the following points may also be relevant:<\/p>\n<ul data-start=\"1921\" data-end=\"2143\">\n<li data-start=\"1921\" data-end=\"1963\">Assumption of costs for relocation or travel<\/li>\n<li data-start=\"1964\" data-end=\"2027\">Integration support (e.g. language course, finding accommodation)<\/li>\n<li data-start=\"2028\" data-end=\"2143\">Repayment agreements in the event of premature termination (e.g. for assumed course costs - check the legal situation carefully!)<\/li>\n<\/ul>","protected":false},"excerpt":{"rendered":"<p>Wenn Sie als Arbeitgeber eine ausl\u00e4ndische Fachkraft einstellen m\u00f6chten, ist ein rechtssicherer Arbeitsvertrag unerl\u00e4sslich.
