Here are the most important points for you as an employer:<\/p>\n<h3 data-start=\"428\" data-end=\"448\"><strong data-start=\"432\" data-end=\"448\">1. probationary period<\/strong><\/h3>\n<p data-start=\"449\" data-end=\"576\">The trial period offers both sides the opportunity to get to know each other and to check whether the collaboration is a long-term fit.<\/p>\n<ul data-start=\"578\" data-end=\"782\">\n<li data-start=\"578\" data-end=\"699\"><strong data-start=\"580\" data-end=\"590\">Duration:<\/strong> As a rule, up to six months (\u00a7 622 BGB). Shorter periods are possible, longer periods only in exceptional cases.<\/li>\n<li data-start=\"700\" data-end=\"782\"><strong data-start=\"702\" data-end=\"744\">Notice period during the probationary period:<\/strong> Two weeks, without giving reasons.<\/li>\n<\/ul>\n<blockquote data-start=\"784\" data-end=\"901\">\n<p data-start=\"786\" data-end=\"901\">Tip: The probationary period should be expressly regulated in the employment contract - including the shortened notice period.<\/p>\n<\/blockquote>\n<h3 data-start=\"903\" data-end=\"942\"><strong data-start=\"907\" data-end=\"942\">2. termination after the probationary period<\/strong><\/h3>\n<p data-start=\"943\" data-end=\"1024\">At the end of the probationary period, the regular notice periods pursuant to \u00a7 622 BGB apply:<\/p>\n<ul data-start=\"1026\" data-end=\"1234\">\n<li data-start=\"1026\" data-end=\"1088\">For the employee: 4 weeks to the 15th or the end of the month<\/li>\n<li data-start=\"1089\" data-end=\"1234\">For the employer: deadlines are extended depending on the length of service (up to 7 months for over 20 years of service)<\/li>\n<\/ul>\n<blockquote data-start=\"1236\" data-end=\"1463\">\n<p data-start=\"1238\" data-end=\"1463\">Note: The following also apply to foreign skilled workers <strong data-start=\"1293\" data-end=\"1331\">general rules on protection against dismissal<\/strong>if the Dismissal Protection Act (KSchG) is applicable (from 10 full-time employees and at least 6 months of employment).<\/p>\n<\/blockquote>\n<h3 data-start=\"1465\" data-end=\"1522\"><strong data-start=\"1469\" data-end=\"1522\">3. special information for foreign skilled workers<\/strong><\/h3>\n<ul data-start=\"1523\" data-end=\"2058\">\n<li data-start=\"1523\" data-end=\"1814\"><strong data-start=\"1525\" data-end=\"1546\">Residence permit:<\/strong> The employment contract and employment ends automatically if the legal basis for employment (e.g. residence permit) ceases to exist - this may be the case, for example, if a visa is refused. A corresponding note should therefore be included in the contract.<\/li>\n<li data-start=\"1815\" data-end=\"2058\"><strong data-start=\"1817\" data-end=\"1868\">Protection against dismissal during the recognition phase:<\/strong> If the specialist is still in the process of having their qualification recognized, the regular employment law provisions also apply - there is no \"special regulation\".<\/li>\n<\/ul>\n<p>German employment law applies to foreign employees <strong data-start=\"2141\" data-end=\"2199\">No special termination rights or deviating deadlines<\/strong> - the protection is identical to that for domestic employees.
