{"id":12465,"date":"2025-03-25T12:20:49","date_gmt":"2025-03-25T12:20:49","guid":{"rendered":"https:\/\/bosporus24.de\/?p=12465"},"modified":"2025-03-23T19:24:22","modified_gmt":"2025-03-23T19:24:22","slug":"diskriminierung-am-arbeitsplatz-rechtlicher-schutz-auslaendischer-mitarbeiter","status":"publish","type":"post","link":"https:\/\/bosporus24.de\/en\/diskriminierung-am-arbeitsplatz-rechtlicher-schutz-auslaendischer-mitarbeiter\/","title":{"rendered":"Discrimination in the workplace - legal protection of foreign employees"},"content":{"rendered":"<p data-start=\"679\" data-end=\"820\">Discrimination occurs when a person <strong data-start=\"723\" data-end=\"769\">is treated unequally or disadvantaged<\/strong> - namely <strong data-start=\"781\" data-end=\"806\">without objective reason<\/strong>e.g. because of:<\/p>\n<ul data-start=\"822\" data-end=\"987\">\n<li data-start=\"822\" data-end=\"849\">ethnic origin<\/li>\n<li data-start=\"850\" data-end=\"870\">the nationality<\/li>\n<li data-start=\"871\" data-end=\"888\">the skin color<\/li>\n<li data-start=\"889\" data-end=\"925\">religion or belief<\/li>\n<li data-start=\"926\" data-end=\"940\">of age<\/li>\n<li data-start=\"941\" data-end=\"987\">of gender or sexual identity<\/li>\n<\/ul>\n<blockquote data-start=\"989\" data-end=\"1153\">\n<p data-start=\"991\" data-end=\"1153\">Even subtle forms, such as derogatory remarks, exclusion or discrimination in the allocation of shifts, can be regarded as discrimination.<\/p>\n<\/blockquote>\n<h3 data-start=\"1160\" data-end=\"1201\"><strong data-start=\"1164\" data-end=\"1201\">Your obligations as an employer<\/strong><\/h3>\n<p data-start=\"1203\" data-end=\"1250\">As an employer, you are obliged under the AGG:<\/p>\n<ol>\n<li data-start=\"1252\" data-end=\"1586\">Your employees <strong data-start=\"1274\" data-end=\"1309\">protect against discrimination<\/strong><\/li>\n<li data-start=\"1252\" data-end=\"1586\">For complaints <strong data-start=\"1330\" data-end=\"1369\">to react appropriately and promptly<\/strong><\/li>\n<li data-start=\"1252\" data-end=\"1586\">A <strong data-start=\"1378\" data-end=\"1405\">Climate open to complaints<\/strong> to create<\/li>\n<li data-start=\"1252\" data-end=\"1586\">In case of violations <strong data-start=\"1436\" data-end=\"1472\">take appropriate measures<\/strong> (e.g. warnings, transfers, training)<\/li>\n<li data-start=\"1252\" data-end=\"1586\">Inform new employees about their rights under the AGG<\/li>\n<\/ol>\n<blockquote data-start=\"1588\" data-end=\"1730\">\n<p data-start=\"1590\" data-end=\"1730\">Tip: Refer to the AGG and the relevant complaints offices in the employment contract, the onboarding process or the company regulations.<\/p>\n<\/blockquote>\n<h3 data-start=\"1737\" data-end=\"1775\"><strong data-start=\"1741\" data-end=\"1775\">\u00a0What happens in the event of violations?<\/strong><\/h3>\n<p data-start=\"1777\" data-end=\"1906\">If an employee is discriminated against because of their origin or religion, this can have serious consequences for your company:<\/p>\n<ul data-start=\"1908\" data-end=\"2131\">\n<li data-start=\"1908\" data-end=\"1998\"><strong data-start=\"1910\" data-end=\"1957\">Claims for damages and compensation<\/strong> by the person concerned (\u00a7 15 AGG)<\/li>\n<li data-start=\"1999\" data-end=\"2050\"><strong data-start=\"2001\" data-end=\"2017\">Loss of image<\/strong> and disturbance of the working atmosphere<\/li>\n<li data-start=\"2051\" data-end=\"2131\"><strong data-start=\"2053\" data-end=\"2087\">Consequences under labor law<\/strong> in the event of repeated or ignored incidents<\/li>\n<\/ul>\n<blockquote data-start=\"2133\" data-end=\"2288\">\n<p data-start=\"2135\" data-end=\"2288\">Particularly tricky: If you as an employer ignore indications of discrimination or do not take them seriously, you can <strong data-start=\"2254\" data-end=\"2272\">Self-liable<\/strong> be made.<\/p>\n<\/blockquote>\n<h3 data-start=\"2295\" data-end=\"2349\"><strong data-start=\"2299\" data-end=\"2349\">Establish protective mechanisms in the company<\/strong><\/h3>\n<p data-start=\"2351\" data-end=\"2493\">In order to effectively protect foreign employees and promote a non-discriminatory work culture, the following measures are recommended:<\/p>\n<ul data-start=\"2495\" data-end=\"2860\">\n<li data-start=\"2495\" data-end=\"2552\"><strong data-start=\"2497\" data-end=\"2525\">Internal contact persons<\/strong> for complaints<\/li>\n<li data-start=\"2553\" data-end=\"2625\"><strong data-start=\"2555\" data-end=\"2585\">Intercultural training<\/strong> for managers and teams<\/li>\n<li data-start=\"2626\" data-end=\"2700\"><strong data-start=\"2628\" data-end=\"2652\">Clear values &amp; rules<\/strong> Anchoring in the mission statement or house rules<\/li>\n<li data-start=\"2701\" data-end=\"2787\"><strong data-start=\"2703\" data-end=\"2742\">Neutrally worded job advertisements<\/strong> (no nationality or age requirements)<\/li>\n<li data-start=\"2788\" data-end=\"2860\"><strong data-start=\"2790\" data-end=\"2810\">Sensitization<\/strong> as part of the onboarding process for all employees<\/li>\n<\/ul>\n<h3 data-start=\"2867\" data-end=\"2883\"><\/h3>\n<p data-start=\"2885\" data-end=\"3164\">Discrimination in the workplace is not only morally unacceptable, but also <strong data-start=\"2968\" data-end=\"2990\">legally prohibited<\/strong>.
